These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms.

Use of Services

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, secure, or error-free.

User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding your account and for all activities that occur under your account.

Intellectual Property

Our website and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

User Content

You retain all rights to any content you submit, post, or display on or through our services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content.

Acceptable Use Policy

This policy applies to prompts, uploaded source images, generated or enhanced outputs, and other content processed through our services.

Prohibited Content

You must not use our services to create, edit, upload, store, or share:

• Sexual or NSFW content: Pornographic or sexually explicit material, sexualized nudity, or non-consensual intimate imagery.
• Violence or gore: Graphic injury, mutilation, torture, or content that glorifies or facilitates serious physical harm.
• Hate speech: Content that attacks, threatens, dehumanizes, or promotes discrimination against people based on protected characteristics.
• Child-unsafe content (CSAM): Any sexualized depiction, exploitation, grooming, or abuse of a minor. We apply zero tolerance to this category.
• Deepfakes or impersonation: Deceptive or harmful depictions of a real person without authorization, including content intended for fraud, harassment, sexual exploitation, or political deception.
• Copyright or trademark infringement: Content you do not have the right to use, including unauthorized reproductions, counterfeits, brand impersonation, or confusing use of protected marks.

Illegal content, fraud, harassment, malware, and attempts to bypass our safety controls are also prohibited.

Content Moderation

We use a layered review process appropriate to each feature:

1. Automated screening: Uploaded source images for enhancement tools are screened before processing with the X-AILab NSFW safety model. Depending on the feature, model providers may also apply safety controls to prompts and outputs.
2. Flagging and triage: Blocked requests, automated safety signals, and user reports are assessed according to severity and urgency.
3. Manual review: When appropriate, flagged content and relevant account or activity records may be reviewed to understand context and confirm whether a violation occurred.
4. Decision and follow-up: We apply proportionate enforcement, preserve evidence when required, and notify affected users when legally and operationally appropriate.

Automated systems cannot identify every violation. Users should report suspected prohibited content so that it can be reviewed.

Reporting and Appeals

Report suspected violations through our contact form or by emailing support@imgenhancer.co. Include the relevant URL, task or account identifier, the policy category involved, and any supporting details. Reports involving child safety or an immediate threat should be clearly marked as urgent.

We keep reporter information confidential where reasonably possible. Users may use the same channels to appeal an enforcement decision and provide additional context. Knowingly false or abusive reports may themselves result in action.

Enforcement

Depending on severity, frequency, intent, and legal requirements, we may reject a request, block an upload, remove content, issue a warning, restrict features, suspend or permanently terminate an account, revoke access to credits or services, preserve relevant records, or report unlawful conduct to payment providers or competent authorities. Severe violations, including CSAM, may result in immediate permanent suspension and reporting without prior warning.

Prohibited Activities

You agree not to:

• Use our services in any way that violates any applicable law or regulation
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of our services
• Attempt to gain unauthorized access to our servers or networks
• Use our services to distribute malware or other harmful code

Billing and Refund Policy

Credit packages are one-time purchases used to access paid features. Current package prices and credit validity periods are shown on the pricing page.

• Unused credits within 7 days: You may request a full refund within 7 calendar days of purchase only if none of the credits from that purchase have been used. Approved refunds remove the corresponding credits from your account.
• Duplicate or incorrect charges: Verified duplicate charges or billing errors are eligible for a full refund.
• Failed processing: If a generation or enhancement task fails because of a system error, credits charged for that task are returned automatically. This credit return is separate from a monetary refund.
• Non-refundable items: Partially or fully consumed credit packages, expired credits, free or promotional credits, and accounts terminated for violating these Terms or the Acceptable Use Policy are not refundable, except where required by law.
• Statutory rights: Any non-waivable cancellation or refund rights provided by applicable law remain available.

To request a refund, submit our contact form or email support@imgenhancer.co from your account email. Include the transaction or order ID, purchase date, and reason for the request. We aim to acknowledge requests within 2 business days. Approved refunds are returned to the original payment method and generally appear within 5-10 business days, subject to the payment provider and financial institution.

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason.

Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page.
